They laid off 300 of us first, saying they would pay us for 60 days (WARN Act), along with our final paycheck (2 weeks in arears) and vacation pay. However, just days later they declared bankruptcy and closed their doors (3000+ people lost their jobs). We are certain that the company knew they'd never have to pay us for the 60 days when they let us go, nor final/vacation pay. We didn't receive a penny until after all the big banks and lenders were paid in the bankruptcy (2011); we received pennies on the dollar for what they owed us.

Nothing was ever done to the corp owners for not adhearing to the WARN Act law. Why? Does declaring bankruptcy absolve you of that? Is there any penalty that can be given them?

It is obvious to everyone that they purposely skirted around the law, took everyone's money, and ran; they hid their millions in off-shore accounts. None of them have been charged with any wrong-doing.

It's wrong on so many levels . . .

Re: WARN Act - Class Action - Class Action Lawsuit

what if the company such as Gateway computers who owned and operated both the Gateway Country store acountry store with over 300 stores world wide . first closed all international stores then a plant in utah 6 months ;ter and in march of 2002 i was called in to work early with no idea that they had without any warning closed the store i worked at and as I arrived for my shift like any other day i arrived to see blacked out windows locked doors and the district manager waiting for me to tell me in person ALL stores were now closed and if we wanted any 2 weeks severance pay we had to pack the store up and actually ended up throwing away most all client files and yard saled the furniture out front . they offerrd 75 shares of worthles stock i never saw and since the store was only using about 40 people to each store they felt exempt yet all stores sclosed the same day the same way?

Re: WARN Act - Class Action - Class Action Lawsuit

Can mass layoffs be 5 people in a company of 12 then For small businesses
