I almost beat the hell out of a banking manager over this exact thing! Fortunatly he put my money back and waved the fees, then i closed the account.. this was PNC bank or Regions bank..idk.. but Southern Bank, and Bank of America got me liek that as well.. im sure they have gotten us all at one point or another.

Re: Unfair Overdraft Protection Fees - Class Action - Class Action Lawsuit

Key Bank did this to me for over two years

Re: Unfair Overdraft Protection Fees - Class Action - Class Action Lawsuit

let’s add PNC and Fulton Bank on the list as well. Both have repeatedly charged me overdraft fees one right after the other for the same item. One time I woke up in my account was overdrawn $175.00 just overdraft fees. When I called Bolton into question why so many overdraft fees were on one transaction they told me that they were unsure, but there was nothing that they could do

Re: Unfair Overdraft Protection Fees - Class Action - Class Action Lawsuit

I love to sign up TD bank and bridgewater bank and bank of America would get you good. I woukd overdraft say 40 bucks on 1 thing. Next thing I know they say oh you hsd these all pending so you have to pay 35 each one and would charge me one time j overdrafted I dollars they charged me 350 in fees for I dollars I had several banks do this. Seems like if you hsd stuff pending they woukd automatically get the highest thing pending posted so everything else woukd get sn overdraft charge not the 1 thing you overdraft on. Biggest scam out there.

Re: Unfair Overdraft Protection Fees - Class Action - Class Action Lawsuit

Chase and Capitol One have done this for years! They've been taking backdated overdraft fees out when people have auto payments that take a few days to process, even if they put money in their account the day of with no "pending transaction" showing. I've taken screenshots that show I have a positive balance, no pending charges, and have waken up the next day to find an alert that says I have a negative balance, a charge that was backdated 2-3 days, and an over draft fee (which is $32). Only way to have overdraft protection is by signing up for a savings account that requires a $200 minimum balance or you pay a monthly fee. Even a CHASE employee said this was not okay.

Re: Unfair Overdraft Protection Fees - Class Action - Class Action Lawsuit

First Convenience Bank/1st National Bank of Texas and Focus Bank should be added to this class Action lawsuit. I would get my SSDI check early if the third fell on a weekend or holiday. They wouldn't debit it until the third and any credits on my account was charged $36 plus another $36 if it wasn't in the bank with in three days plus $14 extra for being over three days. They raked up over $1200 in insufficient fees one year and the following year of 2023, they placed it in a loan status because the banking laws had changed. I had to pay it back in 6 monthly payments. I switched from both banks because they still have charges on me preventing me from opening at another bank. Thank goodness a had switched my check to Bank of America.

Re: Unfair Overdraft Protection Fees - Class Action - Class Action Lawsuit

Go to CFPB and file a claim. It should be investigated under the Federal Rico Act. There is no way justice can be accomplished for consumes unless criminal charges are brought against Wells Fargo's management, not just fines. My elderly mother was charged over $8000 in insufficient fund fees by her credit Union.Once I figured out what was going on, I called the CU several times and they said there was NOTHING that they could do to make it stop snowballing so she continued to be charged several times a day, every day. I filled several reports with the NCUA, as well as the CEO, CFO, management, etc... I went and met with the main people from the CU. They offered $500. Once we closed her account, they "forgot" to close it and she accrued a couple of thousand more in fees. This ruined her perfect credit and has put her in a huge financial situation since then. She has almost lost her house and everything else. She's almost 80 and has Parkinson's disease and I live with her and I do everything I can to help her. I was very disappointed that NO ONE would help us with this situation. So...yea what about Credit Unions?

Re: Unfair Overdraft Protection Fees - Class Action - Class Action Lawsuit

SDCCU has done the same to me on multiple occasions

Re: Unfair Overdraft Protection Fees - Class Action - Class Action Lawsuit

What about credit unions?

Re: Unfair Overdraft Protection Fees - Class Action - Class Action Lawsuit

I've been waiting for three long years for my share of this settlement. The most unnerving thing about this is that they would slap that $35 fee without hesitation. Even if you had direct deposit coming the following day. The problem
Is that now I cannot get a bank account without paying their outrageous fees. They charges me over $750 in overdraft fees, they never paid a dime out for a payment. In one day they charged me an overdraft fee 14 times for the same company trying to send Automatic payment through. 14 times
In one day!!! Ridiculous and what I consider theft, not only due to the money, but the embarrassment and profiling of. All the banks / credit unions do the same, or you have to pay a stop payment fee of about the same amount so that the returned item can't come back in a second time. And, most of the time you don't know if the business automatically presents the item for a second time or not without calling them to verify. Usually it's an automated process and the bank can't even see that the item was returned the first time by the time that you call them to ask the question.

Re: Unfair Overdraft Protection Fees - Class Action - Class Action Lawsuit

Royal Credit Union based out of Wisconsin has taken hundreds of dollars from me with repeated NSF funds.
