Employers are NEVER supposed to ask you to work off the clock. That’s a safety violation. If you were to get hurt during the hours that you were working “off the clock”, it would pose a huge workers comp violatio amongst other ethical issues.

Re: Overtime Pay - Class Action - Class Action Lawsuit

if I worked traveling for a company and my job requirement was to be able to work a continuous 58 hr work week and I went on STD would my company be required to compensate me if I was on paid leave? There were reprocussions to not completing a 58 hr work week like 3 day suspension without pay.

Re: Overtime Pay - Class Action - Class Action Lawsuit

I thought in California, it was anything over 8 hours a day was OT. When paying my the cash he gives me what I would've made with my regular pay rate, just without taking out taxes and usually rounds up. Say I should've made 47$ he gives me 50$.

Re: Overtime Pay - Class Action - Class Action Lawsuit

I would like more information because I worked for rescare as a caregiver and got paid $108 for 24 hours. Workers actually have a lot of rights and protections. If your rights are being violated the law protects you from retaliation by your boss.

Re: Overtime Pay - Class Action - Class Action Lawsuit

John... that is terrible and is definitely a violation of the law. Violations like this happen all the time because greedy employers think that they can take advantage of their workers especially in this economy without any consequences... you should get a lawyer.
