I always request a copy of any disclosures be sent to me. I have now been without a job for almost 2yrs. I have a large unemployment gap, and that also makes it hard. How would I find out who has been looking and has not given a report???????

Re: Employment Background Checks - Class Action - Class Action Lawsuit

To be fair to all parties, if an offer is not tendered and a report was obtained, that report should always be shared. Why? To insure accuracy. This would provide a good check and balance. Secondly, if any information is erroneously reported or there is a dispute regarding the information, that needs to be notated as well. We have that right with our credit reports, it is only reasonable to have that right with a report that is being disseminated which directly affects someone's employment opportunity.

Re: Employment Background Checks - Class Action - Class Action Lawsuit

I had an employment offer rescinded duee to a error on a background check. Do I have recourse?

Re: Employment Background Checks - Class Action - Class Action Lawsuit

I find it is difficult to justify any legal recourse because in order to prove there has been harm done to me I would need to be certain the decision not to hire me was made due to the information obtained in my background report. Now this is because the legal obligations of the employer to report this information (e.g. deciding not to hire based on background report, copy of report, Fair credit reporting act info, agency info, etc.) they just end contact or say they were not able to offer me the job. How can I know if the decision was made due to information in a background check or not? What if I request a copy of the report when I authorize the employer to conduct it, are they under any obligation to provide a copy upon request under Nevada State or Federal Law?

Re: Employment Background Checks - Class Action - Class Action Lawsuit

I THINK THE POINT IS THEY NEED TO SHOW YOU THE REPORT THAT THEY OBTAINED THAT CAUSED THE ADVERSE ACTION. IF YOU EVER APPLIED FOR A CREDIT CARD OR LOAN AND WAS DENIED THEY WILL SEND YOU A LETTR TELLING YOU THE SOURCE WHERE THE INFORMATION WAS OBTAINED.

Re: Employment Background Checks - Class Action - Class Action Lawsuit

do u know how many people get turned down because of back ground/back ground cks.
why are they done if they can get suited?
